More restaurants and facilities nationwide report they can’t sell CBD anymore, even as an official in New York City vows to turn back the Big Apple’s crackdown on CBD use in eateries.

In the past week, enforcement letters and product seizures spread to new jurisdictions, a response to December comments from the U.S. Food and Drug Administration that CBD can’t be put in foods or nutritional supplements until the molecule gets an updated review.

Additional CBD crackdowns have been reported in:

  • Detroit, where health officials told one restaurant to stop serving CBD-infused sodas and a falafel shop to stop selling CBD smoothies.
  • Sarasota, Florida, where police plan to send cease-and-desist letters to gas stations, grocers and stand-alone shops selling CBD products.
  • North Carolina, where the state Department of Agriculture and Consumer Services said it began sending letters to businesses selling food, drinks and animal food while reiterating that CBD can’t be an ingredient.

Meanwhile, a top official in New York City said he wants to halt a similar crackdown happening in restaurants there.

City Council Speaker Corey Johnson told the New York Post that the city health department’s crackdown was an “overreaction” and that he is considering legislation if it continues.
