A Massachusetts federal judge ruled that another lawsuit against a CBD maker alleging incorrect labeling will be delayed, “pending forthcoming FDA regulations on the products at issue.”
Judge Allison D. Burroughs issued the ruling Tuesday, saying she was granting the defendant, Global Widget, a request to stay the case. She denied their appeal to dismiss the case.
Global Widget, a Florida-based company, is accused of selling CBD with “either no amount of the challenged ingredients, or amounts too low to have any pharmacological effect.”
The lawsuit also points out that the U.S. Food and Drug Administration “has not legalized CBD for sale as a supplement.”
Burroughs noted there are three similar lawsuits where other district courts have also stayed the case pending FDA regulations. It’s unclear when those regulations are coming.
