A legal fight over how much tax can be collected on marijuana sales is brewing between county leaders, the pot industry and the state of Missouri.
When Missourians voted to legalize recreational marijuana, they also legalized taxing it. Counties want to tax sales at dispensaries in their unincorporated areas as well as in municipalities, which would “stack” a county tax on top of any municipal tax. Marijuana lobbyists say their amendment made that illegal.
“I think it’s going to end up in court eventually, one way or the other,” said St. Charles County Executive Steve Ehlmann.
Voters in dozens of St. Louis-area counties and municipalities, and at least 70 counties statewide, will be voting on April 4 whether to allow their local governments to tax pot at up to 3%. The local sales tax would be added to the 6% state tax on recreational marijuana.
But the debate over taxation could extend well beyond April. Meanwhile, the Missouri Association of Counties is telling local leaders to put forth ballot language that would allow them to tax across the board, said Steve Hobbs, the lobbyist group’s executive director.
“Counties historically have had the ability to put that on the ballot and any taxes countywide are collected in the cities regardless,” Hobbs said. “The cities reside within the county, not the other way around.”
